Ownership & Licensing
WebQuench owns all data and digital content accessible through its site, including automation templates, strategies, training content, and downloadable resources. Access is licensed, not sold.
You are granted a non-transferable, non-exclusive license to use WebQuench materials strictly for your personal or internal business use, and not for resale, redistribution, public display, or derivative creation.
Prohibited Actions:

Refund & Cancellation Policy
Due to the digital nature of our services, WebQuench does not offer refunds for consulting, AI automations, training programs, or downloadable tools.
All purchases are final. If you are unsure about your readiness to implement, please do not purchase.
Membership or subscription services (if applicable) require a 14-day written notice for cancellation. After cancellation, you will retain access until the end of your billing cycle.
Shipping & International Customers
For any physical products shipped (e.g. branded merch or kits), customers outside the U.S. are responsible for customs, duties, or import fees.
Confidentiality & Non-Disclosure
By using our site, services, or programs, you agree not to disclose or misuse confidential information from WebQuench. This includes:

- Client workflows

Liability Disclaimer
All content is provided "as is" without warranties of any kind. WebQuench disclaims all implied warranties, including fitness for a particular purpose.
WebQuench is not liable for:

Jurisdiction & Legal
These Terms and Conditions are governed by the laws of the State of Texas, without regard to conflict of law principles.
You agree that any disputes will first attempt resolution through mediation. If unresolved, disputes will be settled by binding arbitration in New Braunfels, TX, under the rules of the American Arbitration Association.
SMS/Text Messaging Opt-In Policy
By providing your phone number, you agree to receive SMS or MMS messages from WebQuench for the purposes of delivering requested information, service updates, appointment reminders, and promotional offers related to our services.
Consent: You will only receive text messages if you have explicitly opted in by filling out a form, scheduling a consultation, or otherwise requesting information from us.
Message Frequency: Message frequency varies based on your interactions with our business but will not exceed 4 messages per month unless specifically requested.
Cost: Message and data rates may apply depending on your mobile plan.
Opt-Out: You can opt out at any time by replying “STOP” to any message you receive from us. You will receive a final confirmation message acknowledging your opt-out request.

AI Chatbot Addendum
This section applies to all AI-powered chatbot products, including but not limited to the Mortgage Chatbot, RefiGPT, Home Affordability Navigator, and any future chatbot systems created, managed, or maintained by WebQuench (“Chatbots”).
a. Service Description
WebQuench Chatbots are custom-built conversational tools designed to engage, qualify, and capture leads for clients in industries such as mortgage, real estate, and professional services. Chatbots may be embedded into client websites, CRMs, or landing pages and are offered as software-as-a-service (SaaS).
b. Client Responsibilities
Clients are responsible for ensuring chatbot usage complies with laws (GDPR, CCPA, RESPA, TILA), reviewing chatbot responses prior to public launch, and providing accurate business data.
c. Data Collection & Privacy
All data collected through the chatbot is transmitted directly to the client’s CRM or inbox. Clients must disclose chatbot data collection practices to users via their own Privacy Policy.
d. AI Limitations
Chatbots use AI and may generate responses dynamically. They are not substitutes for professional financial, legal, or lending advice. WebQuench makes no guarantees of accuracy.
e. Maintenance & Support
Clients on a Maintenance Plan ($25/month) receive ongoing prompt refinements and security updates.
f. Fees, Refunds & Cancellation
Setup fees are non-refundable after project initiation. Monthly subscriptions renew automatically until canceled.
g. Liability
WebQuench is not liable for damages, miscommunication, lost leads, or business losses arising from chatbot operation. Total liability shall not exceed the amount paid within the last 90 days.
h. Future Products
This Addendum automatically applies to all current and future chatbot products. Updates will be posted at webquench.com/terms-and-conditions.
Termination
WebQuench reserves the right to terminate your access to services or this website at any time for breach of these Terms. Upon termination, you must cease all use and destroy any copies of protected materials.
